Preparing for 2019: Changes to Guardianships and Protective Proceedings Under the New Article 5 of the Probate Code

The South Carolina Bar CLE Division, the South Carolina Bar Elder Law Committee, Protection & Advocacy for People with Disabilities, Inc., and the South Carolina Developmental Disabilities Council are proud to present an important two-day conference entitled “Preparing for 2019: Changes to Guardianships and Protective Proceedings Under the New Article 5” of the Probate Code. These proceedings allow the Probate Court to appoint an individual to make decisions for another individual who is alleged to be incapacitated.  The 2019 changes to the Guardianship and Protective Proceedings portion of the Probate Code include a major change allowing for lay guardians ad litem.  Under the new law, social workers, nurses, psychologists, and others may be asked to serve as a guardian ad litem in these proceedings.  Other changes to the law include additional due process protections and ways to reduce the cost of the proceedings.
